Boopoo Smart Baby Monitor Software Product License Agreement Please read the "Boopoo Smart Baby Monitor Software Product License Agreement" (hereinafter referred to as "the Agreement") carefully. By downloading, installing, or using the Boopoo Smart Baby Monitor software (hereinafter referred to as "this Software") and related services, you agree to abide by the terms of the Agreement. If you do not agree to the terms of the Agreement, do not install, copy, or use the Software.
The Agreement constitutes a legal agreement between you (the "User") and Boopoo Technology LLC (hereinafter referred to as "Boopoo").
I. Declaration of Rights Boopoo retains all intellectual property rights to this Software and all associated information, including but not limited to written content, icons, images, graphics, colors, interface design, layout, data, programs, printed materials, and electronic documents. These rights are protected under the Copyright Law of the Hong Kong Special Administrative Region of China, international copyright treaties, and other intellectual property laws and regulations.
II. Scope of Rights 2.1 Installation and Use: This Software is provided with the "Boopoo Smart Baby Monitor" hardware (hereinafter referred to as "the Hardware") and may be used by users in conjunction with the Hardware.
2.2 Copying, Distribution, and Transmission: Users may make unlimited non-commercial copies, distributions, and transmissions of this Software, provided that each copy is complete and authentic, including all associated software, electronic files, copyrights, trademarks, and this Agreement. If a user uses the Software for commercial purposes, Boopoo reserves the right to terminate the provision of products and services without prior notice and to seek compensation for any damages as per legal responsibilities.
III. Restrictions 3.1 Reverse Engineering, Decompilation, and Disassembly: You may not reverse engineer, decompile, or disassemble the Software except as permitted by law. Users must adhere to the restrictions of this Agreement.
3.2 Segmentation: This Software must be used as a complete product. Users may not segment or separate any part of the Software.
3.3 Reservation of Rights: All rights not expressly granted in this Agreement are reserved by Boopoo. Users must obtain Boopoo's written consent before exercising any other rights.
IV. Information Required 4.1 Software Features: This Software supports the Hardware and may include features such as:
Real-time Viewing: After installing the Hardware, users can view real-time video and audio from the camera. Voice Calling: The Hardware includes a microphone and speaker, allowing users to communicate with someone at the camera location. Security Alerts: The Hardware can detect movement or unusual noise, take a picture, and send an alert to Tuya's servers, which then notifies the user’s mobile client. This feature is for notification purposes only and may not provide complete or clear evidence. Cloud Recording: Cloud Recording is an optional service that allows users to upload and view recordings on Tuya Cloud servers. Camera Sharing: Administrators can share the camera with other users and manage their access rights. 4.1.2 Registration Service: Users can register a Boopoo account via the Boopoo Security Center website. The Boopoo account is used for accessing Boopoo services. Users must agree to and comply with the Boopoo User Agreement.
4.1.3 Sharing Links: Users should manage and distribute sharing links securely. Users must ensure they have the legal rights or permission to upload, store, share, or transmit content. Content must not infringe on third-party rights or violate laws. Boopoo reserves the right to terminate sharing services and take action if it believes a user has violated this Agreement.
4.2 Application Compatibility: This application is designed for Android smartphones and operating systems officially supported by Android. Users who do not wish to use the application may uninstall it using standard methods provided by the operating system.
4.3 Product Support: Support for this Software is provided by Boopoo.
4.4 Software Updates: Boopoo may modify or update the Software at any time. Data costs for updates will be the user's responsibility.
4.5 Malicious Code: This Software does not contain malicious code, spyware, or any programs designed to interfere with user data or collect private information.
4.6 Prohibited Activities: Users must not engage in activities such as:
Deleting or modifying rights management or electronic information. Circumventing copyright protection mechanisms. Using the Software to mislead or defraud. Violating regulations or interfering with computer systems. Unauthorized network access or alteration. 4.7 Value-Added Services: Boopoo may offer additional services, both free and paid. Boopoo reserves the right to charge for such services and modify payment terms. Users will be informed of changes and must pay for any paid services according to Boopoo’s policies.
4.8 Privacy Protection:
4.8.1 Boopoo commits to complying with the "360 User Privacy Protection White Papers" and all applicable privacy laws.
4.8.2 Boopoo adheres to these privacy principles:
Use collected information to provide valuable services. Develop products that comply with privacy standards. Ensure transparency in information collection. Protect collected information diligently. For details on privacy, visit the Boopoo Center website at www.boopoocare.com.

V. Disclaimer and Limitation of Liability 5.1 User Responsibility: Users assume full responsibility for risks arising from the use of the Software and related services. Boopoo is not liable for any resulting damages.
5.2 Software Compatibility: While tested, Boopoo does not guarantee compatibility or error-free operation. Users experiencing issues can contact technical support or uninstall the Software.
5.3 Limitation of Liability: To the fullest extent permitted by law, Boopoo is not liable for any damages, including personal injury, loss of profits, business interruption, or other economic losses.
5.4 Force Majeure: Boopoo is not responsible for losses caused by telecommunications or internet failures, computer errors, or other force majeure events.
5.5 User Misconduct: Users who cause damage by violating this Agreement may face consequences including termination of rights and legal action.
5.6 Limitation of Liability Statement: For additional matters, refer to the "Boopoo Smart Baby Monitor Limitation of Liability Statement."
VI. Applicable Law and Dispute Resolution 6.1 Governing Law: This Agreement is governed by the laws of the Hong Kong Special Administrative Region of China.
6.2 Dispute Resolution: Disputes should first be resolved through negotiation. If unresolved, disputes may be submitted to the Hong Kong Arbitration Commission. The decision of the HKAC will be final and binding.
VII. Miscellaneous 7.1 Severability: If any provision of this Agreement is found invalid or unenforceable, it will be severed without affecting the validity of the remaining provisions.
7.2 Amendments: Boopoo reserves the right to revise this Agreement based on legal or operational changes. Revised agreements will be published on Boopoo's website. Continued use of the Software constitutes acceptance of the revised Agreement.
7.3 Interpretation: Boopoo reserves the right to interpret and modify this Agreement.
